Madaraka Party Urges CKRC To Redesign Referendum Questions Based On Contentious Issues
Nairobi, Kenya-- September 27, 2005----The Madaraka Party has written to the Constitution of Kenya Review Commission (CKRC) asking them to redesign the referendum question. “The “no-yes” format has been deliberately imposed by the elite to ensure that there is no new constitution come November 22,” the letter says.
The letter is signed by Tegi Obanda, Miheso Musindi, Kiliko Musyoka and
Kironyo Peter on behalf of the Interim Executive Committee of Madaraka Party of Kenya They say the questions should be based only on contentious issues in the Bomas draft
“We believe that the salvation and future of this country lies in effective referendum questions.”
The party has declared the Wako draft illegal and rejects it as a subject of the referendum. They say the Bomas Draft is the only legitimate document that should form the basis for further negotiations by Kenyans.
The party urges the CKRC to assume their proper role in guiding the review to its logical conclusion. The Party suggests that in each contentious issue, CKRC should form two opposing questions, each representing the views of the opposing camps.
They contend that this will make the process less emotive and people will be able to make better-informed decisions based on issues rather than personalities.
“The current referendum campaigns have nothing to do with constitution-making. The contest has boiled down to voting for or against Kibaki.” The letter says.
The party has given the commission up to Wednesday 28 September 2005 to respond to their letter.
“If we do not hear from you or you reject our proposal, we will announce “a third choice”, and take it to the people of Kenya, as the alternative people-driven roadmap to constitutional reform.”
The party will make its stand known to Kenyans at a public forum scheduled to be held at Chrisco City Church Hall, Caxton Building, Kenyatta Avenue, Nairobi on Friday, September 30, 2005, 2.00pm-6.00pm.
The party has proposed sample questions that can assist the CKRC in designing better questions. The sample questions, which are derived from Bomas draft, are on Presidential Powers vs. Prime Minister, number of levels of government, and whether the Kadhi’s Court should be part of state judiciary?
